Under the Fair Work Act 2009 the collective bargaining landscape has changed markedly, requiring the bargaining parties to apply a more collaborative approach to their negotiations. This workshop is designed to provide participants with a sound theoretical understanding and the necessary skills required for best practice bargaining that can be immediately applied in their organisations.
The course will provide participants with the legal framework as well as the practical fundamentals of collective bargaining, taking them through the essential stages of the collective bargaining process, before culminating in participation in an enterprise agreement negotiation simulation. Emphasis will be placed on a ‘mutual gains’ approach to bargaining and its implied opportunities to support a culture of change in the workplace. All participants will be provided with a best practice bargaining tool kit to take back to their workplaces.

At the end of this workshop, participants should be able to: • understand the collective bargaining framework under the Fair Work Act 2009 • understand the practical implications of good faith bargaining • understand the methodology of collective bargaining • apply a professional, systematic and knowledgeable approach to negotiations throughout all stages of the bargaining process from preparation to implementation • effectively use negotiation, influencing and stakeholder management skills in the bargaining process • negotiate enterprise agreements with the best possible outcome for all parties involved • identify pitfalls and caveats and overcome obstacles • explore how enterprise bargaining can support a culture of change and continuous improvement in the workplace and assist in the creation of highly responsive and efficient organisations.
